Terms and Conditions of Hire

Call Centre open 06:00 – 22:00 daily. All new bookings made online, via email or call centre can only be confirmed between these times.

TERMS AND CONDITIONS OF HIRE

  1. HIRE OF GOODS
    The Client hires the Services as described in the respected quotation and invoice. The hired services/vehicles shall at all times remain the sole property of Extra Mile Cabs.
  2. DEPOSIT
    As and by way of security for performance of obligations hereunder, the Client shall pay to Extra Mile Cabs the deposit stated in the respected quotation and invoice, payable three (3) days prior to the rental.
  3. HIRE CHARGES
    As consideration for the use of the hired items, the Client shall pay to Extra Mile Cabs the hire charges stated in the respected quotation and invoice.
  4. INTEREST
    All overdue and outstanding amounts shall bear interest at a rate of 10% per annum and shall be calculated and compounded monthly in arrears.
  5. PERIOD
    The Client hires the services from and until the dates requested. No refunds will be made if not noted to Extra Mile Cabs in advance.
  6. ADDITIONAL CHARGES
    In addition to the charges payable by the Client for the use of the hired services, Extra Mile Cabs shall be entitled to charge the Client for the late return of the hired services at a rate applicable to the specific hire, and the Client shall be liable for the costs of repair of damaged vehicles if not due to the Extra Mile Cabs representative respective to the specific hire or if the damage was not  noted beforehand , the costs of cleaning of unreasonably dirty hired vehicles and the costs of replacement of hired vehicles damaged. The additional charges shall be determined by Extra Mile Cabs in its sole discretion and the Client shall be liable for all such additional charges in terms hereof.
  7. PAYMENT OF ADDITIONAL CHARGES
    All additional charges payable by the Client in terms hereof, shall be payable in cash or by means of debit or credit card or confirmed electronic funds transfer on termination of the hire period, unless and which Extra Mile Cabs shall be entitled to do, Extra Mile Cabs elects to deduct the additional charges from the deposit. Extra Mile Cabs may, in its sole discretion, ask that a credit card consent form be signed by the Client in lieu of a deposit and that any monies due to Extra Mile Cabs, for whatsoever reason, be debited against the credit card in question. If Extra Mile Cabs has agreed to accept payment from the Client by credit or debit card, the Client’s signature hereon shall constitute authority for the issuer of the card to debit the card holder with the total amount due for the additional charges and/or any other amounts due in terms hereof.
  8. ITEMS IN GOOD ORDER AND REPAIR
    The hired items (vehicles) shall be deemed to be in good order and fit for the intended purpose when delivered to the Client, unless the Client notifies Extra Mile Cabs of any defects immediately on collection thereof. Any such defects must be noted on the signed rental agreement or invoice prior to the Client taking delivery of the hired items.
  9. DAMAGE AND MAINTENANCE
    The Client shall keep and maintain the hired vehicles in good order and repair to the standards required by Extra Mile Cabs, until the hired vehicles are returned to Extra Mile Cabs. No alterations may be done to the hired vehicles, unless agreed to and performed by Extra Mile Cabs. The Client shall return the hired vehicles in the same good condition and repair in which they were when received by the Client. The Client shall not dry clean or wash any of the hired vehicles and if any cleaning is required, an additional charge in the amount of R550.00 will be charged to the Client. In the event that any of the hired items are destroyed or damaged at any time prior to the return thereof, Extra Mile Cabs shall be entitled to charge the Client for the replacement costs, which shall be in an amount equivalent to the replacement value of the hired vehicle, as noted on the signed rental agreement or invoice, in addition to any other remedies that it may have in law.
  10. USE OF SERVICES AND VEHICLES
    The Client shall use the hired services at the Client’s own risk, and the Client shall have no claim of any nature against Extra Mile Cabs for any loss of personal items, or damages sustained, or compensation sought by any other party against the Client, arising from any cause, including, without limitation, the use of the hired services.
  11. NO WARRANTIES
    Extra Mile Cabs does not furnish any warranties nor does it make it any representations other than those contained herein and no warranties or representations shall be binding on Extra Mile Cabs unless such warranties or representations are reduced to writing and signed by a duly authorised representative of Extra Mile Cabs. Extra Mile Cabs does not undertake to furnish the Client with any advice, but should it do so, it does not warrant the correctness thereof.
  12. INSURANCE
    All vehicles are insured for Public liability. Proof of such insurance shall be made available upon request.
  13. BREACH
    Should the Client fail to comply with any obligations imposed on the Client in terms hereof, all of which are deemed to be material, and persist in such failure for three (3) days after having been given written notice to remedy such default, Extra Mile Cabs shall be entitled to terminate this agreement and to forthwith retake possession of the hired services and vehicles.
  14. LEGAL AND OTHER COSTS
    Any costs and disbursements, including attorney and own client costs, incurred by Extra Mile Cabs arising out of a breach of any of these terms and conditions by the Client, in tracing the Client and/or in collecting or endeavoring to collect any indebtedness owing by the Client to Extra Mile Cabs, are payable by the Client on demand, including collection commission, and all like charges.
  15. VARIATION
    No variation or alteration of these terms and conditions shall be binding on Extra Mile Cabs unless embodied in a written document signed by a duly authorised director of Extra Mile Cabs. Any purported variation or alterations of these terms and conditions otherwise than as set out above shall be of no force or effect, whether such purported variation or alteration is written or oral, or takes place before or after receipt of these terms and conditions by the Client.
  16. NON WAIVER
    No indulgence granted by Extra Mile Cabs shall constitute a waiver of any of Extra Mile Cabs’s rights hereunder. Accordingly, Extra Mile Cabs shall not be precluded as a consequence of having granted such indulgence from exercising any rights against the Client, which may have arisen in the past or which may arise in future.
  17. GENERAL
    These terms and conditions, together with the signed rental agreement or invoice, constitute the entire contract between the Client and Extra Mile Cabs.

 

General Terms and conditions of Extra Mile Cabs coach and minibus hire.

  • Quotation subject to availability of busses.
  • Driver meals (3x meals) and accommodation are for your account unless alternative arrangements are made.
  • A securing deposit of 50% is required on the date of your confirmation / 21 days before departure date and full payment is due 24 hours before departure.
  • The above rate excludes: any entrance fees, parking, porterage, cross border costs and meet & greet at the airport.
  • The above rate includes: hire, mileage, driver, fuel, toll fees, trailer, passenger & public liability insurance, coach/minibus permits.
  • No smoking allowed on board.
  • In the event of a breakdown Extra Mile Cabs will do all in their power to correct the situation but will not be held liable for any costs or delay caused as breakdowns are unforeseen.
  • Extra Mile Cabs will not be responsible for losses or damages to private property. All passengers are to ensure that on disembarking, all personal property is removed from the coaches.
  • Quotations are valid for 30 days.
  • A cancellation fee of 50% may be charged if the coach/minibus is cancelled 21 days before the departure date and 100% cancelation fee if cancelled 6 hours before the departure date.
  • A penalty charge specified in the quote may be charged for every hour the coach/minibus is utilized that is not specified on itinerary.
  • A valet fee specified in the quote may be charged if applicable.
  • Extra Mile Cabs may at its own discretion use any suppliers for its sub-hire requirements.
  • Payment terms on outstanding balances- STRICTLY 30 Days from date of Invoice. Outstanding amounts will accrue interest at a rate of 15.5% per annum compounded daily.
